  TERMS AND CONDITIONS
 
1 You agree that you must be eighteen years of age or more to use any MYKIDISSAFE service. Any use of the Service by any person under the age of eighteen is to be used only under the direct supervision of an adult MYKIDISSAFE customer. Under no circumstances should any person under eighteen submit any personal information to MYKIDISSAFE. It is always a good idea for parents to directly monitor all internet activity of children at all times.

It is always a good idea for parents to directly monitor all internet activity of children at all times.
 
  MYKIDISSAFE does not make any guarantees that:
 
a] All inappropriate content will be blocked, filtered or removed;
b] Your child will be absolutely safe from inappropriate content;
c] Your child will not engage in inappropriate behavior;
d] Your child will not release personal information about themselves or others;
e] Anyone (including your child) will not be able to circumvent the safety features; of this product by use of obscure language, unknown characters, intentionally misspelled words or any other means; or
f] Anyone will not be able to contact your child by various means.
   
 
3 The Service may not be able to block, restrict, or filter all email attachments, texts, calls, restrict time use, use while driving, video clips, streaming media, photographs, graphics, images, computer programs, games or any audio files, locate your kid, notify you when they leave a specific area or arrive at a specific destination, require them to call you back prior to making or receiving any calls. Items in foreign languages are not reviewed, blocked or filtered. You acknowledge and agree that the MYKIDISSAFE Service may not remove all adult themed and/or explicit sexual content and that the existence of adult themed and/or explicit sexual content or any other dangerous or objectionable content will not be deemed a breach of this Agreement.
 
4 By subscribing to the Service you consent to the potential monitoring of activity on the computer or mobile phone on which the Service is downloaded including, without limitation, the use of applications, such as Word and email, and the internet or any mobile device. You further consent to MYKIDISSAFE's to create software and to use your bandwidth in any way it sees fit.
 
5 By subscribing to the Service and leaving the boxed checked, you hereby authorize MYKIDISSAFE to collect, store and email your contacts from your email program on your behalf about MYKIDISSAFE services. MYKIDISSAFE will not use these email addresses for any other purposes nor sell or distribute them to any other third party. You will be credited for at least one month of service for each new Subscriber that signs up for service using your contacts.
 
6 By subscribing to the Service, you hereby warrant that you will not use the Service to monitor the computer activity of anyone other than persons meeting BOTH of the following criteria: persons who are (i) your children or with respect to whom you are the legal guardian and (ii) under 18 years old.
 
7 No material from the Service, MYKIDISSAFE Website or any Website owned, operated, licensed, or controlled by MYKIDISSAFE may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer or mobile phone for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices.

Modification of the materials or use of the materials for any other purpose is a violation of MYKIDISSAFE's proprietary rights.

 
9 All trademarks, service marks, and trade names are proprietary to MYKIDISSAFE unless otherwise specified.
 
10 MYKIDISSAFE does not transfer title to the software it uses, it only allows you to use it pursuant to a license agreement. MYKIDISSAFE retains full and complete title to the software, and all intellectual property rights therein. Your use of any software associated with the Service will be governed by the terms and conditions of the end user license agreement ("EULA") accompanying such software. Such software is protected by copyright and other intellectual property laws and treaties. MYKIDISSAFE or its suppliers own the title, copyright, and other intellectual property rights in such software, and such software is licensed, not sold. You may not redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce the software to a human-perceivable form

DISCLAIMER - THE SERVICE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, MYKIDISSAFE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MYKIDISSAFE DOES NOT WARRANT THAT THE FUNCTIONS OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

   
12 LIMITATION OF LIABILITY - UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL MYKIDISSAFE BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE THE MATERIALS IN THIS SITE, EVEN IF MYKIDISSAFE OR A MYKIDISSAFE AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
   
13 IN NO EVENT WILL MYKIDISSAFE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICE.
   
14 These Terms and Conditions, and any rights granted hereunder, may not be transferred or assigned by you, but may be assigned by MYKIDISSAFE without restriction.
   
15 These Terms and Conditions will be governed by the internal substantive laws of the State of California , without respect to its conflict of laws principles. Any claim or dispute between you and MYKIDISSAFE that arises in whole or in part from the MYKIDISSAFE Website or Service be decided exclusively by binding arbitration in San Diego County , California .
   
16 These Terms and Conditions , together with any other legal notices published by MYKIDISSAFE on its Website, will constitute the entire agreement between you and MYKIDISSAFE concerning the Service. If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of these Terms and Conditions, which will remain in full force and effect. No waiver of any term of this these Terms and Conditions will be deemed a further or continuing waiver of such term or any other term, and MYKIDISSAFE's failure to assert any right or provision under these Terms and Conditions will not constitute a waiver of such right or provision
   
17 MYKIDISSAFE reserves the right to amend these Terms and Conditions at any time and without notice, and it is your responsibility to review these Terms and Conditions for any changes.
   
18 Your use of the Service following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms. IF YOU ARE DISSATISFIED WITH THE SERVICE, OR YOU DO NOT AGREE WITH ANY PART OF THIS AGREEMENT, OR YOU HAVE ANY OTHER DISPUTE OR CLAIM WITH OR AGAINST MYKIDISSAFE WITH RESPECT TO THIS AGREEMENT OR THE SERVICE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE.
